BUYER: the individual who places an order through penyu.io ("Buyer"), identified by the details provided at checkout.
This Distance Sales Agreement ("Agreement") governs the sale and delivery of products/services ordered electronically by the Buyer through the Penyu website and mobile application ("Platform"), reflecting consumer-protection principles equivalent to Turkey's Law No. 6502 and its Distance Contracts Regulation, and the EU Consumer Rights Directive, to the extent applicable to the Buyer's place of residence.
The Platform offers instant eSIM data packages (digital content) and intermediary booking services for flights, hotels, buses, trains and car rentals. The type, key features, quantity, tax-inclusive price and payment method of the ordered item are shown to the Buyer before the order is confirmed. Payment is displayed in the Buyer's chosen currency and charged securely via Stripe, iyzico or PayTR card payment infrastructure.
Digital products (eSIM activation code/QR) are delivered instantly to the Buyer's Penyu account and registered email upon payment confirmation; there is no physical shipment. For flight, hotel, bus, train and car-rental services, Penyu acts as an intermediary between the Buyer and the relevant supplier; booking confirmation is sent by email and shown in the account, and performance of the service is subject to the supplier's own rules and schedule.
Where applicable law grants a right of withdrawal, the Buyer may withdraw from the Agreement within 14 days of delivery/performance without giving any reason and without penalty, by notifying destek@penyu.io in writing within that period.
The right of withdrawal does not apply to: (a) digital content supplied on a non-tangible medium whose performance has begun with the Buyer's prior consent and where the Buyer has acknowledged loss of the withdrawal right (e.g. an eSIM QR code that has already been scanned/activated or used); (b) services fully or partly performed with the Buyer's consent before the withdrawal period expires (e.g. confirmed and processed flight, hotel, bus or train bookings); (c) goods/services whose price depends on financial market fluctuations (e.g. fares indexed to real-time exchange rates). Outside these exceptions, the right may be exercised as described in Section 5. If the Buyer fails to fulfil a payment obligation, the Seller reserves the right to pursue legal remedies under applicable law. Orders suspected of card misuse may be reviewed and, if necessary, cancelled under our fraud-prevention procedures.
The Buyer may first submit any request or complaint about an order to destek@penyu.io; we respond within 30 days. Where a dispute cannot be resolved directly, consumers may apply to the Consumer Arbitration Committee or Consumer Court competent for their place of residence (subject to applicable monetary thresholds), or, if resident in the EU, to the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
By placing an order on the Platform, the Buyer confirms having read, understood and electronically accepted this Agreement, which takes effect the moment the order is confirmed.
